Governing Law

Any claim relating to Next Level shall be governed by the laws of the Province of Ontario without regard to its conflict of law provisions.

Disputes

Any dispute relating in any way to your visit to the Website shall be submitted to confidential arbitration in the Province of Ontario except that, to the extent you have in any manner violated or threatened to violate Next Level’s intellectual property rights, Next Level may seek injunctive or other appropriate relief in any provincial or federal court sitting in the Province of Ontario and you consent to exclusive jurisdiction and venue in such courts. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Entire Agreement

The above Terms of Service, along with any additional policies referenced to herein, constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Next Level. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Next Level.
